problem applying crossgcc patch

I'm having a problem applying the 
crossgcc-gcc-2.8.2.patch.  I'm getting the following error 
mesage:
 
patching file 'configure.in'  
patch: can't rename 'c:\windows\TEMP/po001039' 
to 'configure.in' : File exists
 
If I move configure.in out of the way, then the 
patch complains that it can't find file to patch at line 46.
