It does seem to be an unfortunate (if unexpected) design "feature" of XHTML
that documents using the tag set, but without the DTD, have different names
(are in different namespaces) from valid XHTML.
Maybe the solution to your problem is to make sure your well-formed
documents all say
<html xmlns="[insertCorrectNamespaceHere]">...</html>
...if you can do that...
