I managed to reproduce this issue; using a fresh checkout of binutils,
I can get it to built past gas and the testsuite passes, but if I apply
 the patch:
 - gas doesn't build without -Wno-error anymore
 - testsuite doesn't pass anymore

I configure from a build subdir with:
 ../configure --enable-shared --prefix=/usr --build=arm-linux-gnueabi \
    --host=arm-linux-gnueabi --with-pkgversion="GNU Binutils for Ubuntu"
then I make and I make check in gas.

 We filed http://sourceware.org/bugzilla/show_bug.cgi?id=10385
erroneously (not noticing this was due to a distro patch) but this
 issue is tracked at
 https://bugs.launchpad.net/ubuntu/+source/binutils/+bug/398732.

My builds were under Ubuntu karmic/9.10 with gcc 4.4 from Ubuntu.

Our binutils package currently fails in the same way:
