Not sure what you are refering to here, but

disable-output-encoding is specified as being an optional feature of
an XSLT implementation so by definition it does not always work.

If it does work, and you get   into the result tree then that is
non well formed XML and a fatal error unless you have also specified a
DTD that defines this entity.

  is the unicode non breaking space character, so if this does not
produce a non breaking space in your application, the application is
broken.
