No. This is a FAQ. (see the faq pages, I'd guess)
equality is = not == and the above would test true for
<elem><anything/><x><y/></x></elem>
sometimes you do want to test for that, but it isn't testing if the
element is empty.
<xsl:when test="elem/node()">
tests if elem has any child nodes (text, comments, elements, pis)
