Why is this a "problem"? That is the law. You have to pick a time limit. If
someone violates your patent on the last day of the legal term, is that any
less a violation than to have done it the day after you filed? 

When patents are violated, it is usually because of ignorance of the laws
and existing patents. But that doesn't make the patent process invalid.
