The tool is GPL and in the same public cvs repository as binutils.
How can that be proprietary?  It even has a special exception for cgen
output files.

So... distribute the .cpu files.  We're in the process of moving them
out of the src/cgen/cpu directory into src/cpu anyway, just for this
reason.
